1.

(a) Definition of personal data:

In accordance with Article 4(1) of the GDPR, personal data is any information relating to an identified or identifiable natural person. A natural person is regarded as identifiable if they can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

(b) Legal basis for the processing of personal data:

Where consent is sought for the processing of personal data, Article 6(1)(a) of the GDPR serves as the legal basis.
Where personal data is processed for the performance of a contract, Article 6(1)(b) of the GDPR is the legal basis. The same applies to pre-contractual measures.
Where the processing serves to fulfil a legal obligation to which the controller is subject, Article 6(1)(c) of the GDPR serves as the legal basis.
Processing carried out to protect the vital interests of data subjects or other natural persons is based on Article 6(1)(d) of the GDPR.
Where processing is necessary to pursue a legitimate interest of the controller or a third party, and where the legitimate interests of the controller do not override the interests or fundamental rights and freedoms of the data subject which require the protection of personal data, Article 6(1)(f) of the GDPR serves as the legal basis for the processing.

(c) Scope of the processing of personal data:

As a general rule, we do not process any personal data when you visit our website. We only do so to the extent necessary to provide and optimise a fully functional website, as well as our content and services. We generally only collect and use our users’ personal data with their consent. This does not apply in cases where the processing of data is permitted by law.

(d) Data disclosure:

We will only disclose data if, for example, this is necessary to fulfil a contractual obligation, if we have a legitimate interest, or if you have consented to the disclosure of your data. We select our contractual partners conscientiously and carefully, and require them to protect all data in accordance with statutory provisions. To this end, data processing agreements are concluded in accordance with Article 28 of the GDPR.

(e) Data erasure and retention period

Your personal data will be deleted as soon as the purpose for which it was stored no longer applies and there are no statutory retention periods preventing its deletion. Where users’ data is not deleted because it is required for other legally permissible purposes, its processing will be restricted; in other words, the data will be blocked and not processed for any other purposes. This applies, for example, to users’ data that must be retained for commercial or tax law reasons.

(f) Links:

Our website may contain links to websites operated by other providers. We are not responsible for the content of those websites. Nor does our privacy policy apply to them.

2. Provision of the website and creation of log files:

Beschreibung und Umfang der Datenverarbeitung:

Each time our website is accessed, the user’s access data required for the use of the website and for billing purposes is stored on the web server (hosting server) in a log file, which your browser transmits automatically.

The following data is logged:

Referrer URL
Hostname of the accessing computer,
Date and time of the server request,
Amount of data transferred,
Access status (file transferred, file not found),
Description of the type of web browser used,
IP address
Purpose and legal basis:
Without collecting the IP address of the accessing computer and the name of the file accessed, it is not possible to establish a connection to our server or to use our website. The data is stored in so-called log files to ensure the functionality of our website. Furthermore, we require the data to optimise our website and to ensure the security of our IT systems.

The legal basis for this data processing is Article 6(1), first sentence, point (f) of the GDPR (legitimate interests of the controller).

Duration of storage, deletion: The data is automatically deleted after 7 days at the latest. If the data is stored for longer than this, the data records are anonymised and analysed for optimisation purposes.
The collection and storage of this data are strictly necessary for the provision of our website. The collection of data for the purpose of providing the website and the storage of data in log files is strictly necessary for the operation of the website. Consequently, the user has no right to object.

3. Cookies

On our website, we use only technically necessary cookies. These are essential for the proper operation and basic functionality of the website and do not require the user’s separate consent.

A cookie is a text file generated by our website’s server, sent to the user’s web browser and stored on the user’s hard drive. These cookies contain a distinctive string of characters that enables the browser to be uniquely identified when the website is visited again.

Cookies cannot manipulate the user’s device and can be deleted manually at any time – most easily via the browser. You can customise your browser settings to reject cookies or to accept them only after confirmation. These cookies, known as ‘session cookies’, serve to enhance the functionality of our website and to make your experience as convenient as possible. Please note that if you reject cookies, not all features of our website may function correctly.

The processing of data via cookies is necessary for the purposes stated, in order to safeguard our legitimate interests and, where applicable, those of third parties, in accordance with Article 6(1), first sentence, point (f) of the GDPR. As your privacy is important to us, any data that could potentially be linked to specific individuals – such as IP addresses, login IDs or device identifiers – is anonymised or pseudonymised at the earliest opportunity. The data will not be used for any other purpose, combined with other data or disclosed to third parties.

4. Contact via e-mail

You can send us enquiries or suggestions by email. The following data may be collected as part of the contact process:

Name, address, email address, company name (if applicable) and any other data you provide via email. This data will be used exclusively to respond to your enquiry and only to the extent necessary for this purpose. The legal basis for this data processing is Article 6(1)(b) of the GDPR (contractual obligation).

5. Social media presence

The Schleswig-Holstein Chamber of Agriculture operates its own, technically separate accounts, for example on Facebook and Instagram, and embeds YouTube videos on its website. The Schleswig-Holstein Chamber of Agriculture’s website does not contain any ‘social plugins’ (= ‘Like’ buttons). As long as you remain within the eip-agrar-sh.de website, no personal data is passed on to Facebook or other social media providers. Personal data is only collected once you access the Schleswig-Holstein Chamber of Agriculture’s social media pages, for example via the links at the top of each page at www.lksh.de.

(a) Privacy policy for Facebook

The Schleswig-Holstein Chamber of Agriculture operates a Facebook fan page. The technical platform and services of Facebook Ireland Ltd. (4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland) are used to provide the content. The Schleswig-Holstein Chamber of Agriculture and Facebook are jointly responsible for data processing in connection with the fan page. When you visit our fan page, personal data is processed by Facebook and by us as data controllers. Please note that by setting up a Facebook account, through the individual settings you choose on the platform, and through your own interaction behaviour (e.g. commenting on, sharing or liking posts), each user acts on their own responsibility and influences the extent to which user data may be collected.

Purpose of processing personal data:
Social media is an important platform for us to provide information. We wish to inform users about the services we offer and to communicate with them. The data visible to us is used exclusively for the purpose of communicating with users and is not actively stored by us. However, Facebook collects a wide range of data when you visit our fan page. It cannot be ruled out that this data may be transferred to countries outside the EU. It is not known how Facebook uses the data collected from visits to Facebook pages for its own purposes, to what extent activities on the Facebook page are attributed to individual users, how long Facebook stores this data, or whether the data collected by Facebook when a user visits the Facebook page is passed on to third parties.
When you access a Facebook page, the IP address assigned to your device is transmitted to Facebook. According to Facebook, this IP address is anonymised (in the case of ‘German’ IP addresses) and deleted after 90 days. Facebook also stores information about its users’ devices; where applicable, this may enable Facebook to link IP addresses to individual users.

If you, as a user, are currently logged in to Facebook, there is a cookie on your device containing your Facebook ID. This enables Facebook to track that you have visited this page and to monitor your user behaviour. This also applies to all other Facebook pages. Facebook buttons embedded in websites enable Facebook to track your visits to this website and link them to your Facebook profile. This data can be used to tailor content or adverts to you.

You can find information on how to manage or delete the information held about you here: https://www.facebook.com/about/privacy#

We do not collect any data ourselves via our Facebook fan page. The data you enter on Facebook – in particular your username and the content published under your account – is processed by us to the extent that we may comment on or reply to your posts. The data you freely publish and share on Facebook is thus incorporated into our service and made accessible to other users. Posts on the Facebook fan page may contain links to external third-party websites. We have no influence over the content of these websites and therefore accept no responsibility for them. We process personal data on the basis of our legitimate interests in effective communication with users on Facebook and visitors to our profile, as well as in connection with our communication with users on Facebook, in accordance with Article 6(1)(f) of the GDPR.
As part of our fan page, we use Facebook’s Insights service. This provides us with anonymised statistical data on visitors to our fan page.

When you visit our fan page, Facebook stores a cookie on your device. This cookie contains a user code that can be linked to you. Unless deleted beforehand, the cookie remains active for two years. The user code can be linked to your data if you are registered as a user on Facebook. The information stored in this way is processed by Facebook. You can find out more about Facebook’s use of cookies here: https://www.facebook.com/policies/cookies/

Facebook members can use the settings in their Facebook account to determine the extent to which their user behaviour may be tracked when visiting our fan page. You can find Facebook’s opt-out form here: https://www.facebook.com/help/contact/1994830130782319

b) Privacy policy for Instagram

The Schleswig-Holstein Chamber of Agriculture maintains an Instagram account. Instagram is an online service for sharing photos and videos, which is owned by Facebook. The app’s default settings are public. However, you can adjust these settings under ‘Edit Profile’. It is the user’s own responsibility to monitor the content they post. Contacts and followers can copy and redistribute uploaded images, meaning you no longer have control over the content you share.
You can read the latest information on Instagram’s privacy policy here: https://help.instagram.com/155833707900388

If you visit our Instagram page and your browser allows cookies to be stored, Facebook will store information and cookies and may access this information when you visit the Facebook platform or a website that incorporates Facebook technologies. Further information on Instagram cookies can be found here: https://help.instagram.com/1896641480634370?ref=ig

We have no control over the data processing carried out by Facebook in connection with cookies. You can still visit our Instagram page even if you set your browser so that no cookies from Facebook are stored. Our Instagram page allows you to react to our posts, comment on them and send us private messages.
The processing of your data when you contact us or interact with our page or its content is carried out on the basis of Article 6(1)(f) of the GDPR. Our legitimate interest lies in responding to your enquiry. We process the data you provide in this context – and any data to which we may have access – in order to safeguard our overriding legitimate interests, as determined following a balancing of interests, in contacting and communicating with interested parties (legitimate interest in data processing pursuant to Article 6(1), first sentence, point (f) of the GDPR).
Your data will, as far as is possible, be deleted when we cease operating our Instagram page. Should Facebook store this data for any further period, such storage shall be governed exclusively by the provisions set out in the Instagram Privacy Policy:
https://help.instagram.com/519522125107875
and the Instagram Terms of Service:
https://help.instagram.com/581066165581870

(c) YouTube Privacy Policy

On our website, we provide links to our YouTube videos. The videos are not embedded on our website.

YouTube is a video platform operated by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

As soon as you start the video by clicking on the preview, a connection is established with YouTube’s servers. You will then leave our website and be redirected to YouTube. In doing so, the YouTube server is informed which of our pages you have visited. If you are logged into your YouTube account, you allow YouTube to link your browsing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account. Furthermore, after you start a video, YouTube may store various cookies on your device or use similar recognition technologies. In this way, YouTube may obtain information about visitors to this website. This information is used, amongst other things, to collect video statistics, improve user-friendliness and prevent fraud. Where applicable, further data processing operations may be triggered after a YouTube video has been played, over which we have no control.

Links to our YouTube videos are provided to ensure an engaging presentation of our online content. This constitutes a legitimate interest within the meaning of Article 6(1)(f) of the GDPR. Where consent has been sought, processing is carried out exclusively on the basis of Article 6(1)(a) of the GDPR; consent may be withdrawn at any time.

It is in our legitimate interest to provide you with multimedia information and thereby expand our range of information. Furthermore, cookies are only set once you actively click away from the preview image.
Legal basis: Article 6(1)(f) of the GDPR.

Google, as the operator of YouTube, is solely responsible for this data processing. Please note that Google may receive further data via cookies already stored on your device. The extent to which Google utilises this data is beyond our control. Further information can be found here: https://policies.google.com/privacy?hl=de
